These Terms of Use ("Terms") govern your access to and use of wayapa.com ("the Site"), including any practitioner training, workshops, online courses, the practitioner community hub, and any merchandise purchased through our affiliated store. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms are governed by the laws of Victoria, Australia.

1. About us

The Site is owned and operated by Wayapa Wuurrk Pty Ltd (ABN 75 138 333 954), an Australian company delivering the Wayapa Wuurrk® earth connection wellness modality through practitioner training, workshops, courses, and educational programs.

2. Intellectual property

"Wayapa," "Wayapa Wuurrk," and associated logos, branding, course materials, and the 14 Elements framework are trademarks and intellectual property of Wayapa Wuurrk Pty Ltd. All content on the Site — including text, graphics, videos, course materials, and downloadable resources — is owned by or licensed to us and protected by Australian and international copyright and trademark law.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as expressly permitted under a licence agreement (for example, a practitioner licence granted on completion of accredited training).

3. Practitioner training and certification

3.1 Completion of the Wayapa Wuurrk Practitioner Training Course is subject to attendance and assessment requirements set out at enrolment. Certification is not guaranteed simply by enrolling or paying course fees.

3.2 Certified practitioners must sign a separate licence agreement governing use of the Wayapa Wuurrk name, logo, and branding, and ongoing licensing obligations (including annual membership fees where applicable).

3.3 We reserve the right to suspend or revoke a practitioner's certification or licence for breach of the licence agreement, our Code of Conduct, or these Terms.

4. Bookings, payments, and cancellations

4.1 Prices for courses, workshops, and merchandise are listed in Australian Dollars (AUD) and are inclusive of GST unless stated otherwise.

4.2 Payments are processed securely by Stripe. We do not store your full payment card details.

4.3 Cancellation, transfer, and refund terms for specific courses, workshops, or retreats are set out at the time of booking and form part of your agreement with us for that booking. Please review these terms carefully before completing your enrolment, as they will govern your rights in relation to cancellations, transfers, and refunds for that specific course, workshop, or retreat.

4.4 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.

5. Merchandise

Merchandise available through the Site is fulfilled by a third-party print-on-demand provider (Printify) via our affiliated store. Purchases made through that store are subject to the third-party provider's own terms and conditions in addition to these Terms, where applicable.

6. Health and participation

6.1 Wayapa Wuurrk workshops, training, and retreats involve physical movement, storytelling, and mindfulness practices. Participants are responsible for advising us of any relevant health conditions, injuries, allergies, or accessibility needs prior to attending, so we can make reasonable arrangements for your safe participation.

6.2 Wayapa Wuurrk is a wellness and earth-connection practice. It is not a substitute for medical, psychological, or professional health advice or treatment. If you have any health concerns, please consult an appropriate qualified professional before participating.

6.3 You participate in any in-person or online session at your own risk. To the maximum extent permitted by law, Wayapa Wuurrk Pty Ltd excludes liability for any injury, loss, or damage arising from your participation, except where such liability cannot be excluded under the Australian Consumer Law or other applicable law.

7. Practitioner directory and community hub

7.1 If you are a certified practitioner, your profile may be listed in our public practitioner directory. You are responsible for the accuracy of the information you provide for your listing.

7.2 The community hub (member area) is provided for the benefit of certified practitioners and community members. You agree to use the hub respectfully and not to post content that is unlawful, harassing, discriminatory, or otherwise inappropriate. We reserve the right to remove content or suspend accounts that breach this expectation.

8. Education programs

Where Wayapa in Education programs are delivered to schools or early learning services, the terms of delivery (including any information exchanged about program participants) will be set out separately with the engaging institution. These Terms apply to the Site itself and general enquiries.

9. User conduct

You agree not to use the Site to:

  • Violate any applicable law or regulation

  • Infringe the intellectual property or other rights of Wayapa Wuurrk or any third party

  • Transmit any harmful, misleading, or unlawful content

  • Attempt to gain unauthorised access to any part of the Site or its systems

10. Third-party links

The Site may contain links to third-party websites (including our merchandise store, payment processor, and social media). We are not responsible for the content, privacy practices, or terms of any third-party site.

11. Disclaimer and limitation of liability

11.1 To the maximum extent permitted by law, the Site and its content are provided "as is" without warranties of any kind, express or implied.

11.2 Nothing in these Terms limits or excludes any guarantee, warranty, or right that cannot lawfully be limited or excluded under the Australian Consumer Law. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to the resupply of services or the cost of resupply.

11.3 To the extent permitted by law, we exclude all liability for any indirect, consequential, or special loss arising from your use of the Site or our services.

12. Indemnity

You agree to indemnify Wayapa Wuurrk Pty Ltd against any claims, losses, or damages arising from your breach of these Terms or your misuse of the Site.

13. Changes to these terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria.
